Terms & Conditions

These Terms & Conditions (the “Terms”) govern your use of https://terratight.com (the “Website”) and any purchase of TerraTight products from this Website. By accessing the Website or placing an order, you agree to be bound by these Terms.

The Website is operated by Synergy & Prosperity Building Material Trading LLC (“TerraTight”, “we”, “us”, “our”), a limited liability company registered in the United Arab Emirates.

1. Definitions

  • “Customer”, “you” — the person placing an order or browsing the Website.
  • “Product(s)” — any TerraTight-branded or otherwise listed item available on the Website (e.g. TerraTight Waterproof Sealant, TerraTight Ease Rock Glue & Sand Binder).
  • “Order” — your offer to purchase Products under these Terms.

2. Eligibility

By placing an order, you confirm that:

  • You are at least 18 years of age and legally capable of entering into a binding contract under UAE law.
  • The information you provide is accurate, complete, and up to date.
  • You are purchasing for legitimate use and not for unlawful resale or distribution.

3. Products and Pricing

  • All Product descriptions, technical specifications, coverage rates and images are provided in good faith for general information. We make reasonable efforts to ensure accuracy but do not guarantee that all descriptions are error-free, complete, or current.
  • Real-world coverage, drying time, and appearance may vary depending on surface preparation, application technique, temperature, humidity, and aggregate type. Always conduct a small test area before full application.
  • All prices are listed in AED (UAE Dirham) and include 5% VAT unless otherwise indicated.
  • We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout.
  • In the event of an obvious pricing error (e.g. a Product listed at a fraction of its true price), we reserve the right to cancel the Order and issue a full refund.

4. Orders and Contract Formation

  • Placing an order on the Website constitutes an offer to purchase. We accept your offer when we send the Order Confirmation email; at that point a contract is formed between you and Synergy & Prosperity Building Material Trading LLC.
  • We may refuse, cancel, or limit any order at our discretion, including for reasons of stock availability, suspected fraud, customer history, or restricted shipping zones.
  • If we cancel an order for which payment has already been made, we will issue a full refund to the original payment method within 7–14 working days.

5. Payment

  • We accept payment by debit/credit card (Visa, Mastercard, Amex) through Stripe, cash on delivery where it is offered at checkout, and any other methods displayed at checkout.
  • Card payments are taken in full when you place your order. Cash-on-delivery orders are paid in full to the courier on delivery.
  • For wholesale or bulk orders, alternative terms (e.g. bank transfer, partial advance) may be agreed in writing in advance.
  • Stripe processes payments under its own terms and privacy policy. We do not store full card details on our servers.

6. Delivery

Delivery is governed by our Shipping & Delivery Policy. In summary:

  • Shipping is to UAE addresses only (other destinations on request).
  • Standard shipping fee: 19 AED. Free shipping on orders 170 AED and above.
  • Estimated delivery: 1–5 working days depending on emirate.

We are not liable for delays caused by couriers, customs (for cross-border consolidations), force majeure, or incorrect customer information.

7. Risk and Title

  • Risk in the Products passes to you upon delivery.
  • Title in the Products passes to you upon full payment being received.

8. Returns, Refunds and Cancellations

Returns and refunds are governed by our Returns & Refunds Policy. In summary:

  • 7-day return window from the date of delivery for unopened, resaleable items.
  • Buyer pays return shipping for change-of-mind returns; we cover return shipping for our errors and defective items.
  • No returns of opened resin / sealant / adhesive containers (hygiene and product-integrity reasons).

9. Use of Products & Limitation of Liability

9.1 Customer responsibility

You acknowledge that TerraTight products are construction and landscaping chemicals. You agree to:

  • Read all product labels, datasheets and application instructions before use
  • Wear appropriate personal protective equipment (gloves, eye protection, masks where indicated)
  • Use only for the intended purpose described on the product page or datasheet
  • Conduct a test patch before full application
  • Keep products out of reach of children and pets
  • Dispose of empty containers and unused product in accordance with UAE waste-disposal regulations

9.2 Liability cap

To the maximum extent permitted by UAE law:

  • Our total liability for any claim relating to the Products or Website is limited to the amount you paid for the relevant order.
  • We are not liable for: indirect, incidental, consequential, or punitive damages; loss of profits, business, or data; cost of substitute products; damage caused by misuse, improper application, failure to follow instructions, or use outside the intended scope of the Product.

Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded under UAE law, including the UAE Federal Consumer Protection Law.

10. Intellectual Property

  • All content on the Website — including the TerraTight name, logo, product names, photographs, text, graphics, and design — is owned by or licensed to Synergy & Prosperity Building Material Trading LLC and is protected under UAE and international IP law.
  • You may not copy, reproduce, distribute, modify, or use any of this content for commercial purposes without our prior written permission.
  • Personal, non-commercial browsing of the Website is permitted.

11. User Conduct

When using the Website, you agree not to:

  • Use the Website for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Website, server, or related systems
  • Introduce malware, viruses or other harmful code
  • Interfere with the operation or security of the Website
  • Misrepresent your identity or affiliation
  • Use automated tools (bots, scrapers) to extract content or data without our written permission

12. Reviews and User-Submitted Content

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai.

Any dispute arising from or connected to these Terms, your use of the Website, or any Order, shall be subject to the exclusive jurisdiction of the courts of Dubai, without prejudice to your statutory consumer rights.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
